Zooble complies with all data protection legislation currently in force.

When you sign up to participate in or receive a quotation/service from Zooble, we will ask for the minimum information appropriate to fulfil such requests, and therefore different web pages within this site may ask for different personal information.

Where you have given us information we will keep your information confidential except where disclosure is required or permitted by law (eg. to government bodies and law enforcement agencies to assist in the detection of criminal acts) and we will only use your information within Zooble to prepare services on your behalf.

What is a Cookie?

A third-party cookie is one issued by a different server to this website and could be triggered by a hyperlink to that site or a banner advert within this site.

Use of first party Cookies in this website for the purpose of Analytics - this website uses Google Analytics for the purposes of improving the site's performance and content for everyone. Specifically, Google Analytics is completely anonymous and simply allows us to evaluate, for example:

  • What are the most popular pages on my site?
  • What pages don't visitors appear to like?
  • What browsers are my visitors using?
  • What days or times bring the most visits?

Google Analytics currently sets 4 cookies with the following lifespans - a session cookie, a 24hr cookie, a 6mth cookie and a 2 year cookie.

This information is not shared with anyone other than Zooble Technologies - for the purpose of maintaining the site's accessibility and performance, and the website owner - for the purpose of assessing and enhancing page content and website usability for their customers' benefit.

Customer Information Provided To/From Zooble

The Customer warrants that the name, address and payment information provided when initially contracting for Zooble's services is correct, and subsequently agrees to notify Zooble of any changes in name, address and/or payment details as soon as possible.

The Customer warrants that they are at least 18 years of age and that they possess the legal right and ability to enter into an Agreement with Zooble.

The Customer accepts full responsibility for keeping their own MyZooble account details confidential (Account and User ID and password) where supplied. Where the customer believes their account details have been compromised they must inform Zooble immediately and a small fee may be chargeable for change and re-issue of account authorisation details.

Zooble accepts no responsibility for Customer's links to other web sites, resources, advertisements or sponsorships, and does not endorse their contents, unless expressly described.

Customer Web Site Information

Zooble will not monitor the contents of the Customer's pages where a CMS has been supplied. Any files that the Customer uploads to their web pages (either via the supplied CMS or by any other means) are subject to withdrawal without notice by Zooble upon complaint about their content, or where Zooble - at their sole discretion - deem this necessary.

The Customer warrants the reliability and accuracy of any information displayed on their web site, and also agrees that Zooble may disclose the Customer's name and address where there is any complaint about this content or in relation to any goods or services advertised there.

The Customer is entirely responsible for any civil or criminal liability incurred as a direct result of their use of the web pages supplied to them by Zooble, and the Customer may not, under any circumstances publish, distribute or disseminate (through e-mail, bulletin or web site services supplied by Zooble) any of the following on their web site:

  • defamatory/libelous messages, including the engagement in illegal or unlawful activities;
  • defamatory/infringing/obscene/indecent or other unlawful material or information;
  • violate the legal rights (including rights of privacy and publicity) of others through threatening or abusive missives or postings;
  • violate intellectual property laws of software or other digital materials, unless the Customer owns or controls the rights thereof, or has received all necessary consents;
  • knowingly upload files that contain a computer virus or corrupted data with the intent of damaging Zooble systems and integrity;
  • offer to sell goods/services via their web site unless they undertake to provide such goods and services as described on their web site, and to comply with all current legislative requirements, including the Trades Descriptions Acts.

Zooble shall not be liable for any posting, transmission or reception of information which infringes any UK law or regulation, or which infringes any third party rights - such activity is strictly prohibited and Zooble reserves the right to suspend or terminate the Customer's service at any time such activity is suspected. Where any illegal activity is suspected by Zooble, we may notify the authorities and reserve the right to undertake any services on the website deemed necessary to protect our system and to preserve any required evidence.

Additionally, the Customer agrees to pay Zooble any legal fees, expenses and damages arising out of any claims made against us or our services by any external parties where those claims are related to unauthorised use of the Customer's web site (as defined above). In any such cases, Zooble undertake to notify the Customer immediately of any such claim.

Contract Termination

Zooble reserves the right to terminate or temporarily suspend the Customer's contract without prior notice should the Customer fail to comply with these Terms and Conditions.

Where Zooble terminates the Customer's contract with cause (including any of the above prohibited activities), or the Customer terminates their contract, the Customer will not be entitled to any refund of any unused part of their contract.

Where the Customer requires Zooble to transfer currently hosted domain names to another Internet Service Provider, then an administration charge of £30 will be levied. This administration charge is payable prior to the domain transfer being completed.

IPR

Zooble will not distribute Customers' web sites under any circumstances, but will include information about them, including hyperlink, in Zooble's own promotional materials and advertising Portfolio.

All web site coding, scripts, databases, images or other digital products created by Zooble remains the property of Zooble.

Payment Terms

Payment terms are strictly 30 days, and Zooble reserve the right to remove, or suspend the Customer's web site or e-mail services if payment is not received during this period.

Payments for domain name registrations must be paid for in advance of Zooble making the registration on the Customer's behalf.

Prices shown on formal Zooble quotations are valid for 30 days from the date of that quotation.

Refunds

Refunds will be given solely at the discretion of Zooble's Management, and upon receipt of a formal request in writing.

Exclusion of Warranties and Limitation of Liability

Zooble cannot guarantee that the host provider will never be infiltrated by unauthorised users, and the Customer assumes that data risk. Where the Customer believes infiltration of their website has taken place, and can provide just evidence, the Customer must immediately inform Zooble, who will take steps to prevent future infiltration and - where appropriate - notify the appropriate authorities.

Zooble services are provided "as is". Zooble make no express or implied representations or warranties to the Customer regarding the usability, condition or operation of such services, but will - at all times - attempt to maintain an uninterrupted service to the Customer, and to safeguard Customer's data hosted on its systems, but accept no responsibility for loss or damage to Customer's data.

Aside from contrary clauses in this Agreement, in any event Zooble are deemed to be in breach of Contract, the Customer agrees that Zooble's liability is limited to the amount paid by the Customer for the services supplied to them by Zooble. The Customer hereby releases Zooble from any and all obligations, liabilities and claims in excess of this agreed limitation.

Zooble assumes no responsibility for, and shall not be liable for, any damage resulting to your computer through the use of this Site.

Complaints Procedure

If you wish to make a complaint about any Zooble services then please contact your Zooble Project Manager in the first instance, after which the complaint will then be escalated where deemed necessary.
